December 14, 2009: Monthly Board Meeting

Body:
The Regular Monthly Board Meeting of the Village Board was held this evening, Monday, December 14, 2009 with the following Board Members present:  Mayor Richard Pugh, Trustees Raymond Daviau, Margaret Stephenson and Richard Shaffer.  Trustee Brenda Gilberti was absent.  Also present was Police Chief Dominick Hiffa, Department of Public Works Superintendent Charles Tritten, Codes Enforcement Officer Chester Kowalski, Village Attorney Richard Parker, Assistant Fire Chief Duane Evans and Planning Board Chairman Robert Friedlander.

 

Also in Attendance:  Dave Glenn

 

Mayor Pugh called the Meeting to order at 7:00 P.M. followed by the Recital of the Pledge of Allegiance and Mayor Pugh asking for all of us to remember our Troops during this Holiday Season.

 

APPROVAL OF MINUTES:  Motion Trustee Daviau, second Trustee Stephenson to approve the Minutes of the December 3, 2009 Voucher Meeting as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

CORRESPONDENCE:  Clerk/Treasurer Goding informed the Board of receiving an email from the NYSDOT announcing that a CHIPS payment to the Village of Whitesboro in the amount of $60,629.49 will be deposited via EFT (Electronic Fund Transfer) into the Village of Whitesboro's General Fund Account at Citizens Bank on December 16, 2009.

CODES ENFORCEMENT DEPARTMENT:  Motion Trustee Shaffer, second Trustee Daviau to approve the Month of November 2009 Codes Enforcement Department Report as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

FIRE DEPARTMENT:  Motion Trustee Stephenson, second Trustee Daviau to approve the Month of November 2009 Fire Department Report as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

POLICE DEPARTMENT:  Motion Trustee Shaffer, second Trustee Daviau to approve the Month of November 2009 Police Department Report as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

DEPARTMENT OF PUBLIC WORKS:  Motion Trustee Daviau, second Trustee Stephenson to approve the Month of November 2009 DPW Report as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

HISTORIAN DEPARTMENT:  Motion Trustee Shaffer, second Trustee Stephenson to approve the Month of November 2009 Historian's Report as presented.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

OLD BUSINESS:  Mayor Pugh called upon the Clerk/Treasurer asking if the Village had received any bids for the 2003 Ford Crown Victoria that was for sale "as is".  The Clerk/Treasurer stated one bid had been received and then opened said bid.  The bid was from Norman J. Nimey, 64 Oriskany Blvd., Whitesboro, New York in the amount of $1,015.00.  A discussion then occurred.  Mayor Pugh asked Police Chief Hiffa what he thought of the bid.  Chief Hiffa stated that it could cost the Village at least $3,000.00 to determine what is wrong because of the nature of the electronic problems should the Village keep the vehicle and recommended that the Village accept the bid.  His conclusion was affirmed by the DPW Superintendent Charles Tritten.

 

Motion Trustee Shaffer, second Trustee Stephenson to accept the bid of $1,015.00 from Norman J. Nimey, 64 Oriskany Blvd., Whitesboro, New York for the 2003 Ford Crown Victoria Police car being sold in "as is" condition based upon the recommendation of Police Chief Dominick Hiffa to accept said bid for the reasons stated.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

Mayor Pugh called upon DPW Supt. Tritten and stated that the two of them need to start working together on a budget for the repair of sewers, manholes, etc. so that the Village of Whitesboro is in compliance with the Oneida County Consent Order of 2014.

 

Attorney Parker addressed the Board with relation to the Public Hearing scheduled on January 7, 2010 for the adoption of proposed Local Law #1, 2010.  Attorney Parker has been working with Clerk/Treasurer Goding and requests the Board pass a new resolution this evening with corrected wording for the proposed local law and then the Clerk/Treasurer can forward over the announcement for a legal notice to the Observer Dispatch as soon as possible.

 

Motion Trustee Daviau, second Trustee Shaffer to approve conducting a Public Hearing on Thursday, January 7, 2010 at 7:15 P.M. at the Village Office, 10 Moseley Street, Whitesboro, New York regarding the adoption of Local Law #1, 2010, which is a local law amending Zoning Chapter 130 of the Code of the Village of Whitesboro, Oneida County, New York to revise a portion of the Zoning classification on Powell Avenue from "Cemetery" to C-2.  The parcel affected is 400' fronting on Powell Avenue and 159' deep commencing at a point 216.57' easterly from the intersection of the southerly line of Powell Avenue and easterly line of Clyne Place.  The local law will also approve amending the Zoning Map to depict such change in classification for the subject parcel.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

Clerk/Treasurer Goding then requested permission from the Board to pay a few invoices that came in after Voucher night, but have a due date before the end of the month and the next voucher night, which is January 7, 2010.

 

Motion Trustee Shaffer, second Trustee Daviau authorizing Clerk/Treasurer Susan M. Goding to pay Claimant Excellus Blue Cross/Blue Shield with Check No. 25635 in the amount of $7,015.88 for the payment of the Month of January 2010 Employee Health Insurance Coverage with a premium due date before December 31, 2009.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

Motion Trustee Daviau, second Trustee Shaffer authorizing Clerk/Treasurer Susan M. Goding to pay Claimant NBLIC-Disability Insurance with Check No. 25636 in the amount of $158.25 for the payment of October, November, and December, 2009 Disability Insurance Coverage with the premium due date of December 31, 2009.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

Motion Trustee Shaffer, second Trustee Daviau authorizing Clerk/Treasurer Susan M. Goding to pay Claimant Ford Motor Credit Dept. with Check No. 25637 in the amount of $7,624.48 for the payment of the 3rd Lease Payment on the 2008 Ford Crown Victoria with a payment due date of December 23, 2009.  Vote:  Trustee Gilberti - absent, Trustee Shaffer - yea, Trustee Daviau - yea, Trustee Stephenson - yea, Mayor Pugh - yea.  Approved.

 

Police Chief Hiffa then spoke to the Board about a concern he has at the Police Station.  He stated there is a mold problem on the walls of the boiler room and more spots are showing on the carpet.  Chief Hiffa believes the Village needs to do something.  The Oneida County Health Department gives out a list of Contractors related to assisting with these types of problems.  There is a cost of approximately $450.00 to $500.00 to do testing, and then further costs to repair.  The Board will do inquiries into this concern.

 

DPW Supt. Tritten informed the Board that some of the DPW Employees are inquiring on the topic of possible insurance buy-outs.  A few of the employees are covered under their spouses insurance and if they were allowed an insurance buy-out it could save the Village money.  The Board agreed to discuss this topic at a later meeting.

 

Attorney Parker informed the Board that he has information on the Title search for 155 Main Street and will give a report on all of the information at the January 11, 2010 Monthly Board Meeting.

 

Mayor Pugh then asked if there were any further topics of discussion and there being none asked for a motion to adjourn so that all in attendance could enjoy the wonderful homemade food on display for a Holiday celebration.  Being there is no Workshop/Meeting scheduled for the Month of December 2009 Mayor Pugh wished everyone a blessed Holiday and Happy New Year.
